Personal information is collected to identify you when we obtain a credit check, to make initial credit approvals and related credit functions. Information gathered over time such as billing records, consumption/purchasing history and service history are used to administer our invoicing and accounting system as well as for warranty and related service purposes. Such information may also be used from time to time for internal marketing purposes. MacGillivray Fuels Limited is not in the business of selling or providing client lists or other personal information to others. Instances where your personal information may be disclosed include: 1) providing your identifying information to credit reporting agencies to obtain a credit check in order to determine your credit worthiness; 2) providing information to new owners of a property, landlords and/or property managers. This may include but is not limited to fuel consumption and service history; 3) providing account information to our auditors, upon their request, on a sample basis when confirming our year end accounts receivable. To protect customers’ privacy and security, reasonable steps are taken to verify an individual customer’s identity before processing requests, granting access or making corrections to personal information. We will require that account number and other identifying information be provided to ensure the information is given to or changed by the appropriate person. As part of our commitment to maintain the accuracy, confidentiality and security of your personal information, we have adopted the following ten principles. These principles are based on the Canadian Standard Association’s Model Code for the Protection of Personal Information and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). 1. Accountability MacGillivray Fuels Limited is responsible for maintaining and protecting the personal information under its control including information that has been transferred to a third party for processing. MacGillivray Fuels Limited will continue to use contractual or other means to ensure a comparable level of protection while personal information is in the possession of a third party. MacGillivray Fuels Privacy Officer, in conjunction with all staff at MacGillivray Fuels Limited, will ensure continual compliance with these principles. 2. Identifying Purposes MacGillivray Fuels employees will explain, either before or at the time of collection, the purpose for which any personal information is being collected. Depending on the way in which the information is collected, this can be done orally or in writing. Under normal circumstances, MacGillivray Fuels Limited will not collect, use or disclose customers’ personal information for any purpose other than for what it was intended, which is to establish and maintain a customer relationship for the delivery of products and services. Application forms explain the purposes for the information collected. Unless the new purpose is required by law, the consent of an individual will be obtained again if and when there is any change in the intended purpose of the use of personal information already collected. 3. Consent Individuals will be informed of the purposes for which the information will be used and consent will be obtained for the collection of personal information and the subsequent use or disclosure of this information, except where required or permitted by law or where consent is otherwise inappropriate. Consent can be oral or written depending on the circumstances and the type of information collected.
4. Limiting Collection The collection of personal information by MacGillivray Fuels Limited will be limited to that which is necessary for the identified business purpose and will only be collected using fair and lawful means. 5. Limiting Use, Disclosure and Retention MacGillivray Fuels Limited will not use or disclose personal information for any purpose other than that for which it was originally identified, unless new consent is obtained or when it is required or permitted by law. Personal information is retained only as long as necessary for the fulfillment of the identified purpose. 6. Accuracy MacGillivray Fuels Limited will continue to keep personal information as accurate, complete and up-to-date as may be necessary to fulfill the purposes for which it is to be used. Personal information will not be routinely updated, unless such a process is necessary to fulfill the purposes for which the information was collected. 7. Safeguards All employees at MacGillivray Fuels Limited are aware of and appreciate the importance of maintaining confidentiality of personal information. Personal information will continue to be protected using security safeguards appropriate to the sensitivity of the personal information. MacGillivray Fuels Limited will continue to protect personal information against loss, theft, unauthorized access, disclosure, copying, use or modification. All information will be protected regardless of whether it is in paper or electronic format. Measures of protection include but are not limited to locked cabinets and storage areas, restricted and or limited accessibility to offices/areas, the use of passwords and encryption as well as procedures regarding the proper disposal of personal information once the identified purpose has been fulfilled. 8. Openness MacGillivray Fuels Limited will make available specific information about its policies and practices relating to the management of personal information that is under its control. This information will be made readily available, over the phone, through the mail as well as on-line on the company’s web site (http://www.macgillivrayfuels.ca/). 9. Individual Access Upon written request to the company’s Privacy Officer, an individual will be informed of the existence, use and disclosure of their personal information that is under MacGillivray Fuels control, and may be given access to that personal information as required and permitted by law. This will include disclosure of the content of the information held, the source from which it came, a description of the use, and a list of any third party which may have received the personal information. Individuals are entitled to challenge the accuracy and completeness of that personal information and request that it be amended, if appropriate. MacGillivray Fuels Limited will respond to an individual’s request for information within a reasonable time (under normal circumstances, within 30 days) and at minimal or no cost to the individual. 10.
